Limitation of Liability

CARFAX Canada's Products (as defined in our Conditions of Use, which may be accessed at https://www.carfax.ca/about-carfax/privacy-legal/conditions-of-use), including Vehicle History Reports, are compiled based on data obtained from multiple sources. It is not always possible for CARFAX Canada to obtain complete information on all vehicles, therefore, there may be other title brands, odometer readings or discrepancies that apply to this vehicle that are not reflected on our Products. CARFAX Canada searches data from additional sources where possible, but all problems and discrepancies may not be reflected on a given vehicle history report or other Product. These Products are based on information supplied to CARFAX Canada by external sources believed to be reliable, but no responsibility is assumed by CARFAX Canada or its agents for errors, inaccuracies or omissions. Reports and other Products are provided strictly on an "as is where is" basis, and CARFAX Canada further expressly disclaims all warranties, express or implied, including any implied warranties of merchantability or fitness for a particular purpose regarding the relevant report or other Product. CARFAX Canada shall not be liable for any delay or failure to provide an accurate report of or other Product if and to the extent such delay or failure is caused by events beyond the reasonable control of CARFAX Canada including, without limitation, acts of God or public enemies, labor disputes, equipment malfunctions, material or component shortages, supplier failures, embargoes, rationing, acts of local, state or national governments, or public agencies, utility or communication failures or delays, fire, earthquakes, flood, epidemics, riots and strikes. CARFAX Canada’s data relating to insurance claims and coverage is provided by various private and public insurance sources across Canada. We rely on them to provide accurate and up-to-date information; however, our information is subject to what we receive directly from these insurers. Insurance - Any claim payments and adjustments made after the date of the report may result in a change to the information presented. The information can be incomplete or show 'No Details' for any of the following reasons:

  1. Past damage to a vehicle could have gone unreported if:
    • the vehicle was not insured by the specific insurer the time such past damage occurred;
    • the owner repaired it at their own expense;
    • the owner did not make a claim to the insurer;
  2. The insurer denied a claim or the insured did not follow through with a claim
  3. The vehicle was insured under a fleet or garage policy. If so, repair information about the individual vehicle may not be available
  4. The vehicle was insured by an insurer that does not report accident claims data to CARFAX Canada; or
  5. Damage occurred but the insurer has not yet paid out any amounts with respect to the damage. CARFAX Canada and its data suppliers do not make any representations as to whether repairs detract from or add to the vehicle or its value. To have as complete a picture as possible of the condition of the vehicle, you should have it inspected by a qualified mechanic.
